Terms of Use

These terms of use ("terms") constitute an agreement between the business customer and Ventures Builder Omega AB (559360-6683), a company formed under Swedish law. Ventures Builder Omega AB provides a platform with the aim of making it easier to collect, manage and administer reviews and feedback.

These Terms govern the use of the Platform and shall apply to all Members using it.

1 DEFINITIONS

1.1 To avoid repetition, below is a list of words that have special meaning in the Terms.


"Feedback finder"
The platform provided by Ventures Builder Omega AB through the Website.

"we", "our", "us"
Venture Builder Omega AB

 

"The Website"
www.feedback finder.se

 

"you", "your", "you", "your"
You who use Feedback finder's services.

 

"User", "The User", "The Customer", "The Company", "The Person",  
The natural or legal person who uses Feedback finder's services as a business customer and its control panel.

 

"Platform"
The platform we provide in accordance with the Terms, including but not limited to our website, which is currently provided at www.feedback finder.se

 

"Profile"
Business customer profile page.

 

"The Terms"
These Terms of Use.

Feedback finder and members may also be referred to individually as "Party" and collectively as "Parties".

2 ACCEPTANCE OF TERMS
 

2.1 Before using our services provided through the platform, the customer must have read, understood and accepted the terms. By ticking the "I accept" box during account registration, the customer agrees to strictly follow the terms and conditions and be legally bound by the terms in relation to us.

 

2.2 The person creating the account and/or using the Feedback Finder Platform warrants that they have full authority to legally bind their company to the Terms and to strictly comply with the Terms when using the Platform.

 

2.3 If the Customer does not agree to the Terms or any updated version thereof, the Customer may not use the Platform.

 

2.4 The Customer can access the latest version of these Terms on the Platform at any time.

3 ACCOUNT CREATION


3.1 To gain access to the Platform, the company needs to create a user account with a valid email address.


3.2 The purpose of the platform is to facilitate the collection of feedback. The customer is responsible for providing correct, current and complete information in connection with the registration. The Customer confirms that the account information provided is true and correct and that, when necessary, the Customer will update its account information so that it remains true and accurate.

3.3 The customer is solely responsible for maintaining the confidentiality of login information. We take no responsibility for any unauthorized use of the Customer's account by logging in with valid information.

4 USE OF THE PLATFORM


4.1 The purpose of the platform is to make it easier for companies to collect feedback, both from their customers and employees.

4.2 The customer can create and manage their account and create and edit their questions.

 

4.3 The Customer undertakes to use the Platform in accordance with applicable laws and regulations and may not use the Platform in any way that causes us or any third party damage. Furthermore, the customer is responsible for his account and communication with his customers and employees.

4.4 The Customer may not use the Platform to communicate or publish information (including but not limited to Customer Content) that violates persons or companies, or their rights (copyright, trademark or other intellectual property rights), information that may violate the integrity of a person, intimidate or offend another person, information that may incite criminal acts, or contain material that is not permitted under applicable laws or regulations (for example, discrimination and/or racial slurs).

5 FEES AND PAYMENT

 

5.1 In connection with creating an account, the customer may choose a payment plan and register payment details. These payment details are handled by a third-party provider called "Stripe".

We use Stripe  for maximum security around payment in our platform. This means you can pay with VISA, Mastercard or AMEX. Among the millions of other companies that use Stripe today are the Cancer Foundation, Unicef, Adidas and Facebook.

Stripe does not require registration, but you pay directly with your payment card without hassle.

All parties involved in the handling, transmission or storage of credit card information must comply with a certain industry standard for security - PCI DSS. Stripe has been audited by a PCI certified auditor and is certified to PCI Service Provider Level 1, the highest possible certificate. If someone were to access the data on Feedback finder's servers, they would get no more than a token of numbers and letters representing the card on Stripe's servers.

No part of the actual card transaction takes place on our side. Then when the actual payment is to take place, you are transported directly to Stripes Checkout via encrypted SSL protocol. No information about credit cards or the like goes through Feedback finder.se. For more information about security, technology and procedures regarding card payment, we recommend that you contact Stripe direct.

ATTENTION! Feedback finder therefore does not have access to the credit card information and will not be able to provide you with information from the credit card. Stripe creates a "token" that represents the credit card information and does not give you access to the card's information in plain text.

 

7 WARRANTY


7.1 The Customer accordingly warrants that use of Feedback Finder's content will not infringe any third party's intellectual property rights.

 

7.2 The Company warrants that its Content complies with the Terms and all applicable laws and regulations.

 

7.3 If the customer is notified or otherwise becomes aware of any claims related to the aforementioned guarantees, the customer shall immediately inform us and assist us in any action we deem appropriate.

 

8 PRIVACY


8.1 We are committed to maintaining the integrity and security of personal data. Personal data provided to us is processed in accordance with our personal data policy and the Personal Data Act (1998: 204) (Swe: Persondatakslagen) or the General Data Protection Regulation GDPR (EU 2016/679), depending on what is applicable.

9 DURATION AND TERMINATION


9.1 These terms and conditions come into force when the Customer registers an account and apply until further notice unless otherwise stated. The customer can cancel the account at any time. Which means that the Customer's right to use the Platform ends with 30 days written notice, unless otherwise agreed in writing with us. The terms apply until the Customer's account has been closed. Information on how to close the account is available on the platform. In the case of an agreed binding period, the customer is invoiced for the remaining period of the agreed period.

9.2 We reserve the right, at our sole discretion, to terminate the customer's account and the right to use the Platform without any financial or other liability to the customer. The customer is always informed of any termination.

9.3 If the Customer's account is terminated, we may, at our sole discretion, remove all information, the Customer's content and any other content relating to the Customer's use of the Platform.

 

10 NO WARRANTY


10.1 THE PLATFORM AND ALL CONTENT, CONTENT AND FUNCTIONS AVAILABLE THROUGH THE PLATFORM, INCLUDING TEXT, GRAPHICS, INFORMATION, LINKS OR OTHER ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE".

 

10.2 WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, FOR THE PLATFORM, INCLUDING BUT NOT LIMITED TO THE AVAILABILITY OF THE PLATFORM. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION OR CONTENT PROVIDED THROUGH THE PLATFORM. WE DO NOT WARRANT THAT CUSTOMER'S USE OF THE PLATFORM WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE, ERROR-FREE, OR WILL MEET THE REQUIREMENTS OF PARTICIPANTS, OR THAT ANY DAMAGE TO THE PLATFORM WILL BE CORRECTED.

 

 

11 LIMITATION OF LIABILITY


11.1 WE SHALL NOT BE LIABLE AND WE HEREBY EXPRESSLY DISCLAIM ALL CLAIMS OR DAMAGES, DIRECT OR INDIRECT, OF ANY KIND AND NATURE ARISING FROM OR IN ANY WAY RELATED TO THE PLATFORM. CUSTOMER EXPRESSLY AGREES TO HOLD US LIABLE FOR ANY CLAIM, CONTROVERSY, OR DAMAGES THAT MAY ARISE FROM ANY DISPUTE BETWEEN CUSTOMER AND ANY CUSTOMER OR THIRD PARTY.

12 DAMAGES


12.1 CUSTOMER AGREES TO INDEMNIFY, DEFEND, AND HOLD US HARMLESS FROM AND AGAINST ANY CLAIMS, LOSSES, EXPENSES, OR CLAIMS FOR LIABILITY, INCLUDING BUT NOT LIMITED TO REASONABLE ATTORNEYS, FEES, AND COSTS IN CONNECTION WITH ANY CLAIM ARISING FROM CUSTOMER'S USE OF THE PLATFORM AND/OR PARTICIPANTS' BREACH OF THESE TERMS; INCLUDING IF PARTICIPANTS' CONTENT VIOLATES THE INTELLECTUAL RIGHTS OF THIRD PARTIES.

 

14 APPLICABLE LAW AND PLACE OF MEETING


14.1 These Terms shall be interpreted in accordance with and governed by the laws of Sweden, without regard to its conflict of laws.

14.2 Any dispute, controversy or claim arising from or in connection with these Terms shall be finally settled by Swedish courts, with the Stockholm district court as the court of first instance.
